THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.1392 of 2015 ORDER:
The case of the petitioner is that he purchased land admeasuring Ac.0.44 cents in survey No.78/3C of Rachanapalli Village, Anantapuram Mandal, from one Guggilla Premavathi and others, vide registered Doc.No.408/2014, dated 28.04.2014, and he has also purchased another piece of land admeasuring Ac.0.44 cents in survey No.79/3A from one Dalavaye Chinna Venkatappa, vide registered Doc.No.1405/2014, dated 23.08.2014, and since then, he has been in possession and enjoyment of the same. With an intention to convert the said land, he filed an application, dated 13.10.2014, before the Revenue Divisional Officer, Anantapuram, the 3rd respondent herein, under Section 3(2) of the Andhra Pradesh Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 (for short 'the Act'). He has also paid the requisite fee of Rs.38,700/- to that effect. The simple grievance of the petitioner is that the 3rd respondent is not disposing the said application. Hence, this writ petition.
Learned counsel for the petitioner submits that as per proviso to sub-section (6) of Section 3 of the Act, if no order is passed on such request, within the time stipulated therein, the required permission shall be deemed to have been given. Learned Assistant Government Pleader, on the other hand, submits that he does not have any objection for disposal of the writ petition, with a direction to the respondents to pass appropriate orders on the application said to have been submitted by the petitioner.
Recording the said submission, the writ petition is disposed of, directing the 3rd respondent to dispose of the application, dated
13.10.2014, submitted by the petitioner, within a period of 15 days from today. The petitioner is directed to place a copy of this order before the 3rd respondent and the same shall be construed as an intimation, to enable him to proceed with and to pass appropriate orders thereon. There shall be no order as to costs. The miscellaneous petitions filed in this writ petition shall also stand disposed of.
