HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.21184 of 2017 ORDER:
After taking note of prayer and the recommendation of 3rd respondent, this court is of the view that prayer for mandamus in the peculiar facts and circumstances, if considered by this court would amount converting the writ remedy into execution proceedings. Hence, the discretion or jurisdiction of this court is not exercised in the fact situation of this case.
The writ petition is dismissed. However, liberty to approach the District Collector against the pending grievance is granted. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
