ORDER:
This writ petition is filed seeking the following relief: ".......to issue a writ order or orders, more particularly one in the nature of writ of Mandamus, declaring the action of the Tahsildar in not considering and disposing of the application of the petitioners dated 29.09.2014 and 21.10.2014 with regard to the granting of house site pattas to the petitioners in Sy.Nos249/1 and 250/1 of Kanuru Village, Penamaluru Mandal, Krishna District and seeking to dispossess the petitioners form the land is highly arbitrary, illegal, unreasonable and violative of Article 21 of the Constitution of India and issue a consequential direction directing the respondents to consider and dispose of the said applications by furnishing the information and not to dispossess the petitioners from the land..."
As can be seen from the prayer, the grievance of the petitioner is that there is no response to the queries made by the petitioners on 29.09.2014 and 21.10.2014.
The learned Assistant Government Pleader for Revenue (A.P) placed on record the instructions, dated 02.02.2015, received from the Tahsildar, Penamaluru Mandal, Krishna District, which reads as under: "Smt. Janga Devamani resident of Door No.680, Umasankaranagar, Kanuru Village of Penamaluru has sent a letter dated 27.08.2014 through Registered Post (received on 01.09.2014) requesting for supply of copies of Adangals for 1406, copy of house site register for the year 1996 under Right to Information Act, 2005. The information was supplied to the petitioner along with copies vide this reference RTI SPL. R. No.47/2014, dated 17.09.2014.
Again the petitioner has filed an application through Registered post on 21.10.2014 (received on 01.11.2014). The same was registered in this office RTI Register vide Serial Number 66 of 2014 and also sent information vide RTI SPL.R.No.66/2014, dated 19.1.2014 by post stating that 1) the classification of the land in R.S.No.249/1 and 250/1 of Kanuru Village is
'Government Poramboke-Punta'; 2) no record is available on issue of house site pattas in the said land;
3) this office file A/316/91 has not been traced and 4) it is not possible to issue copies of house site pattas, as there is no record in token of issue of house site pattas in the said land."
In the light of the above said communication, the grievance of the petitioner, as on today, stands redressed. Therefore, no useful purpose would be served in keeping the writ petition pending. Accordingly, the writ petition is closed. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed. _____________________ CHALLA KODANDA RAM, J.
