THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9850 of 2019 O R D E R:
This writ petition is filed for the following relief: "...to issue any writ order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondents in stopping the illegal quarrying and transporting of sand from Vagu (River) which flows from Kangal Mandal to Ibrahimpet Village, Anumala Mandal and Village, Nalgonda District and further in spite of specific complaint dated 25.02.2019 which is illegal, arbitrary and contrary to law and also in violation of Article 14 of the Constitution of India and also in violation of MMC Act and consequently direct the respondents to take immediate steps to stop the illegal sand mining going on at Vagu (River) which flows from Kangal Mandal to Ibrahimpet Village, Anumala Mandal and Village, Nalgonda District ....."
When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue raised in the present Writ Petition is squarely covered by the order, dated 25.03.2019, passed by this Court in Writ Petition No.6035 of 2019. Relevant portion of the aforesaid order reads as under: "In the present case, as it is the case of the petitioners that they made complaints on 26.02.2019 and 18.03.2019 to the District Collector-2nd respondent, I deem it appropriate to direct the 2nd respondent to treat the said complaints as the complaints filed before the complaint adjudicating committee in terms of G.O.Ms.No.9 dated 24.02.2016 and pass appropriate orders after giving an opportunity of hearing to the petitioners, within seven days, as per the amended Rule 4(3)(III)(c) of the said G.O.
, and communicate the orders to the petitioners. It is needles to mention that as the said Rule itself prescribes for passing of a speaking order, the said committee shall strictly follow the procedure prescribed.
With the above direction, the Writ Petition is disposed of."
Following the aforesaid order and for the reasons stated therein, this Writ Petition is also disposed of in terms thereof.
