HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P. NAVEEN RAO Writ Petition No. 16606 of 2015 PC:(Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the petitioner does not press this writ petition and seeks liberty to the petitioner to approach the respondents against the application, if any, made by respondent No.5 seeking regularisation of the unauthorised structure/construction based on G.O. Ms. No. 128, dated 22.5.2015. He seeks direction to the Government to consider the petitioner's representation within time frame.
The writ petition is disposed of as not pressed. It is open to the petitioner to make a representation, as aforementioned, seeking appropriate relief and if any such representation is made, we hope and trust that the concerned respondent shall consider the same on merits in accordance with law. If the petitioner makes any prayer in the representation against respondent No. 5, it is needless to mention that the concerned authority shall issue notice to respondent No.5 and grant her an opportunity to submit her reply to the representation of the petitioner. It is made clear that this Court has not examined merits of the case. Consequently, pending miscellaneous petitions shall also stand closed.
