THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1523 of 2015 ORDER:
The case of the petitioner is that initially he was granted Occupancy Right Certificate under the A.P. (TA) Abolition of Inams Act, 1956, on 03.11.2010; against which, an appeal was filed before the 2nd respondent-Joint Collector, Mahabubnagar, by Smt. Banda Sathyamma W/o Late B.Bheemiah and others. The Joint Collector, while allowing the appeal by an order dated 16.07.2011, remanded back the case to the 3rd respondent-Revenue Divisional Officer (RDO) for conducting de novo enquiry as contemplated under Section 149 of A.P. (TA) Land Revenue Act, 1317 fasli to pass orders in accordance with law. The grievance of the petitioner is that the 3rd respondent-RDO had not taken up the case and the matter is kept pending, on account of which, he is suffering.
2. The learned Assistant Government Pleader for Revenue [Telangana] submits that he had not received instructions from the respondents, particularly, the time frame within which the proceedings could be concluded pursuant to the orders of the 2nd respondent-Joint Collector. I am not inclined to adjourn the matter any further, especially, considering the prayer of the petitioner which is limited to a direction to the 3rd respondent to complete the enquiry in accordance with law pursuant to the remand orders dated 16.07.2011 of the 2nd respondent.
3. In the facts and circumstances of the case, this writ petition is disposed of by directing the 3rd respondent to dispose of the case No.K/2346/2009 within a period of 12 weeks from today, if the same
has already not been disposed of. It is needless to mention that before passing order, the 3rd respondent shall give adequate opportunity of hearing to all the parties concerned. No costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
