HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.10494 of 2007 ORDER:

Heard Mr.C.Ramachandra Raju for petitioners and the Assistant Government Pleader for Revenue.

The petitioners are substantially aggrieved by the threatened interference of respondents of petitioners' possession of various extents mentioned in the writ affidavit at Regulachilaka village, while the enquiry taken up, pursuant to notices in R.C.No.54/ 07 are pending, as illegal, arbitrary and unconstitutional.

The respondents have filed counter affidavit and in the counter affidavit, it is stated that the very purpose of issuing notices is to take up enquiry under the A.P.Assigned Lands (Prohibition of Transfers) Ac t, 1977 and pass orders. Therefore, the respondents have no intention to forcibly evict the petitioners. Apart from the statement made in the counter affidavit, it is to be noted that on 16.05.2007, this Court by granting order of status-quo protec ted possession of petitioners. In view of the above circumstances, this Court to meet the ends of justice, disposes the writ petition as follows :- (a) The interim order granted on 16.05.2007 is made as final order in the writ petition.

(b) The 4th respondent is given liberty to proceed with the enquiry, and since 10 years from the date of issuing notices had expired, will afford further opportunity to petitioners and pass orders and communicate the same to petitioners.

(c ) The petitioners, if are aggrieved, can work out their remedies in accordance with law. The writ petition is disposed of accordingly. No order as to costs.
