THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.33738 of 2010 ORDER:

This Writ Petition is filed to declare inaction of 1st respondent in finalizing the matter before him consequent upon disposal of C.T.A.121 of 2006 and batch dt.02-03-2009 by the A.P. Cooperative Tribunal, Hyderabad.

I have already passed a detailed order in W.P.No.18963 of 2005 that the Sale Certificate dt.28-05-2005 as well as the registration done on 16-06-2005 of the Sale Certificate would abide by the result of the final surcharge order which may be passed by 2nd respondent or the District Cooperative Officer before whom the surcharge proceedings are now pending.

In this view of the matter, the 2nd respondent is directed to complete the proceedings, which are pending before him after the order dt.02-03-2009 in C.T.A.No.121 of 2006 and batch was passed by the A.P. Cooperative Tribunal, Hyderabad, within three months, positively.

Accordingly, the Writ Petition is disposed of. No costs. 5.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
