THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.8032 OF 2018 ORDER: (per SK,J) The petitioner, the applicant in O.A.No.297 of 2018 before the Andhra Pradesh Administrative Tribunal, Hyderabad, is aggrieved by the dismissal of her O.A. vide order dated 20.02.2018. The said O.A. was filed by the petitioner/applicant seeking a direction to the authorities to consider her case for promotion to the post of Town Planning Supervisor without reference to the Charge Memo dated 11.11.2016 issued against her by the Director of Town and Country Planning, Andhra Pradesh. By the order under challenge, the Tribunal held to the effect that it was not for it to prejudge the issue by standing in the shoes of the Selection Committee or the promoting authority and accordingly non-suited the petitioner/applicant.
We are now informed that a similar issue fell for consideration before this Court in W.P.No.41441 of 2017 and by order dated 22.01.2018, the said writ petition was disposed of setting aside the order passed by the Tribunal on similar lines as in the present case and directing the authorities to consider the case of the petitioner therein under the provisions of G.O.Ms.No.257, General Administration (Ser-C) Department, dated 10.06.1999.
Learned Government Pleader for Services fairly states that the aforestated order squarely applies to the case on hand also. For reasons alike as were stated in the aforestated order and in terms thereof, the writ petition is allowed setting aside the order dated 20.02.2018 passed by the Tribunal in O.A.No.297 of 2018 and directing
the respondents herein to consider the case of the petitioner as per the provisions of G.O.Ms.No.257 dated 10.06.1999.
