THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.23656 OF 2008 ORDER:

This writ petition is filed seeking a direction to the respondents 1 and 2 not to pay compensation to the respondents 3 to 83, who were stated to be encroachers, without considering the objections of the petitioner and without following the procedure laid down in the Land Acquisition Act and consequently direct the respondents 1 and 2 to deposit the entire compensation amount in the civil Court.

This Court, vide order, dated 05-11-2008 granted interim direction directing the respondents 1 and 2 not to disburse the compensation amount without considering the objections of the petitioner in representation, dated 18-02-2008, 29-02-2008 and 05-04-2008 pending disposal of the wit petition. 3.

Today, when the matter is taken up for consideration, learned Government Pleader on the basis of written instructions submitted to him, stated that the objections filed by the Land Acquisition Officer in respect of the land acquired were numbered as L.A.O.P.Nos.218, 219 and 220 of 2016 and they are pending. The land in the instant case was acquired way back in the year 2008. The petitioner is claiming title to the land, whereas respondents 3 to 83 are also making a claim for receiving compensation. Since the said L.A.O.Ps are pending, this Court is not inclined to decide the present writ petition, except directing the learned II Additional District Judge, Kadapa at Proddatur to dispose of the same.

Accordingly, the writ petition is disposed of directing the II Additional District Judge, Kadapa at Proddatur to dispose of L.A.O.P.Nos.218, 219 and 220 of 2016 on his file as expeditiously as possible, but not later than 30-04-2017 and the petitioner and

the respondents 3 to 83 shall co-operate for disposal of the above L.A.O.Ps. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed. _______________________________ A.RAMALINGESWARA RAO, J DATED: 09-11-2016 Hsd
