THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.11399 of 2013 ORDER:

In this Petition filed under Section 482 Cr.P.C., the petitioner/accused No.1 seeks to quash the proceedings in Cr.No.149 of 2013 on the file of Amangal Police Station, Mahabubnagar District, whereunder the petitioner and three others were charged for the offences under Section 504, 353 and 188 of Indian Penal Code.

When the matter came up for hearing, learned Public Prosecutor by producing a copy of the charge sheet submitted that the police have filed charge sheet on 02.01.2014, which was taken cognizance and numbered as C.C.No.06 of 2014 by the learned Judicial First Class Magistrate, Kalwakurthy, and hence, the instant petition, which is filed for quashment of the proceedings, has became infructuous and prayed to dismiss the petition. There is no representation for the petitioner. It is seen that pending Criminal Petition, no stay was granted in this case.

On perusal of the copy of charge sheet dt.02.01.2014, this Criminal Petition is dismissed as infructuous and liberty is given to the petitioner/A.1 to challenge the charge sheet by initiating appropriate proceedings.

Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
