THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1298 OF 2015 ORDER:
The order impugned is an appealable order under Section 4(A) of the A.P.Assigned Lands (Prevention of Transfer) Act, 1977 (for short 'the Act') and as per the Act, the appeal can be filed within 90 days from the date of receipt of the order. The record discloses that the order impugned having been signed on 24.11.2014 there is still time to the petitioner for filing appeal under the Act. It is needless to mention that even though the possession was taken, the petitioner's right of filing appeal and seeking stay of the order impugned cannot be made nugatory.
In that view of the matter, till such time as the petitioner files appeal within the time provided under the Act and till the disposal of the stay petition that may be filed along with the appeal, there shall be stay of dispossession. The application filed by the petitioner may be disposed of within thirty days from the date of filing of such petition. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions pending if any in this writ petition, shall stand closed.
