THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23644 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to Issue a Writ of Mandamus or any other appropriate Writ or Writs, order or orders or Direction, declaring the action of the Respondent in not considering the representation of the Petitioner dated 28.10.2016 and the legal notice dated 14.05.2017 and 29.06.2017 for refund of transfer duty amount of Rs.1,12,500/- paid in favour of the Respondent, as wholly illegal, arbitrary and without jurisdiction, consequently to direct the Respondent to forthwith consider the legal notice of the Petitioner dated 14.05.2017 and 29.06.2017 for refund of transfer duty paid by the Petitioner amounting to Rs.1,12,500/-, and pass such other and further orders as are deemed fit and proper in the circumstances of the case."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct the respondent herein to consider the representation, dated 28.10.2016, and the legal notices, dated 14.05.2017 and 29.06.2017, of the petitioner and pass appropriate orders in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, the respondent is hereby directed to consider the representation, dated 28.10.2016, and the legal notices, dated 14.05.2017 and 29.06.2017, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible,

preferably, within a period of four (4) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
