JUSTICE SHAMEEM AKTHER W.P.NO.2983 OF 2021 O R D E R (Per the Hon'ble Sri Justice A.Rajasheker Reddy) Sri P.Hari Prasad, learned Standing Counsel for the respondent - Bank submits that petitioner has already filed S.A.No.323 of 2019 on the file of Debts Recovery Tribunal - I under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, challenging the measures initiated by the Bank for recovery of the amount, and he also filed interlocutory application seeking interim relief.

Learned counsel for the petitioner could not dispute the above submission of the learned Standing Counsel for the respondent - Bank. It is to be seen that petitioner cannot pursue parallel remedies. Hence, we are not inclined to entertain the writ petition, and the same is disposed of leaving it open to the petitioner to pursue the securitization application filed before the Tribunal.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
