HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.16335 of 2017 Order:

This Writ Petition is filed challenging the proceedings No.L/233/2017 dated 22.03.2017 passed by the second respondent in directing the third respondent to seize the property belonging to the petitioner situated in Flat No.T-1, Vishal Arcade, Defence Colony near Bharani Colony, Neredmet, Malkajgiri.

Learned counsel for the petitioner states that the petitioner has nothing to do with Crime No.99 of 2017 registered under Section 370(A)(1) IPC and Sections 3, 4 and 5 of the PITA Act, 1956. The premises were let out to a tenant and the tenant might have been involved in the offence. Since the tenant has vacated the premises and he is no longer residing there, there is no need for seizure of the premises.

The said facts have to be taken into consideration by the second respondent on the report of the fourth respondent and for the said purpose liberty is given to the petitioner to submit a representation pursuant to the order dated 22.03.2017 within one week from the date of receipt of a copy of this order and on receipt of such representation the second respondent shall pass appropriate orders in accordance with law within two weeks thereafter.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
