THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.296 OF 2016 ORDER:

1. This revision case is filed by the petitioner against the order dated 18.12.2015 passed in Crl.M.P.No.168 of 2015 in MC No.34 of 2014 by the Family Court, Mahabubnagar.

2. The 2nd respondent is the wife and the 3rd respondent is the daughter of the petitioner. The 2nd respondent filed the above MC against the petitioner. The 2nd respondent filed the above Crl.M.P. on her behalf and on behalf of her daughter against the petitioner claiming interim maintenance at the Rs.5,000/- per month each. After conducting enquiry, the trial Court allowed the above Crl.M.P. in part granting interim monthly maintenance at the rate of Rs.4,000/- per month to the 2nd respondent and Rs.2,000/- to the 3rd respondent. Aggrieved by the same, the petitioner filed this revision.

3. Heard and perused the material available on record.

4. Learned Counsel for the petitioner submitted that the petitioner is not doing any job and he has no income and that the interim maintenance granted to respondents 1 and 2 is excessive and usurious.

5. There is no dispute as to the relationship between the parties. Considering the facts and circumstances of the case and in view of the above submission made by the learned Counsel for the petitioner and in view of the pendency of the above M.C., this Court is inclined to pass the following order:

I) The petitioner is directed to pay Rs.2,000/- per month to the 2nd respondent and Rs.1,000/- to the 3rd respondent on or before 10th of every succeeding month till disposal of the above

M.C.;

II) The petitioner is further directed to pay the arrears of maintenance at the rate fixed by this Court from the date of filing of the petition i.e., Crl.M.P.No.168 of 2015, within a period of three months from the date of receipt of a copy of this order; III) The trial Court is directed to dispose of the above M.C., as expeditiously as possible, without being influenced by the above order.

6. Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
