M/S Hotel Saptagiri v. The State Of Telangana

THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.24084 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or orders more in the nature of Writ of Mandamus declaring the action of the respondent Nos.2 & in not considering the representations of the petitioner dt.20/09/2016 & 14/07/2017 for collecting and clearing the refuse, garbage and waste, in spite of collecting property tax and trade licence fee from the petitioner's Hotel as illegal, arbitrary, violation of Article of the Constitution of India and violation of Sec.480 of the GHMC Act, 1955 and consequentially direct the respondent Nos.2 & 3 to collect and clear the refuse, garbage and waste from the petitioner's Hotel." 2.

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent Nos.2 and 3 to consider the representations, dated 20.09.2016 and 14.07.2017, of the petitioner and pass appropriate orders in accordance with law. 3.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent Nos.2 and 3 are hereby directed to consider the representations, dated 20.09.2016 and 14.07.2017, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible, preferably, within a period of four (4) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
