THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3460 OF 2016 ORDER:
The present criminal petition is filed by the petitioner challenging the order, dated 26.02.2016, passed in Crl.M.P.No.13 of 2016 in Criminal Appeal No.18 of 2016, by the Court of the VI Additional Sessions Judge (III FTC), Warangal, at Mahabubabad, whereby the Court below dismissed the petition filed by the petitioners challenging the order of the trial Court in granting residence, protection and compensation orders to the second respondent herein. Heard and perused the records.
Learned counsel for the petitioners submits that the second respondent is a influential person having connections with the political parties and if the second respondent started living in the residence of the petitioners, there is every likelihood of breach of peace in the house.
Considering the facts and circumstances of the case, the order, dated 12.02.2016, passed in D.V.C.No.1 of 2014 by the Court of the Additional Judicial Magistrate of First Class, Mahabubabad, to the extent of granting residence and protection orders, is hereby set aside. However, the first petitioner is directed to pay an amount of Rs.3,000/- (Rupees three thousand only) per month to the second respondent for her alternative accommodation, on or before 10th of every succeeding month. It is made clear that if the first petitioner fails to pay the same, the order passed by the lower appellate Court shall restore automatically. With the above directions, the Criminal Petition is disposed of. Consequently, the miscellaneous petitions pending, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 16.03.2016 pln
