THE HON'BLE SRI JUSTI CE C.PRAVEEN KUMAR W RI T PETI TI ON No. 4 5 8 8 9 of 2 0 1 6 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

2.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

3.

The present Writ Petition came to be filed with the following prayer:

'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ or order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in not considering the petitioner's representation dated 16.08.2016 for grant of patta to the petitioner in respect of the land admeasuring Acs.02.52 cents situated in Survey No.524/ 1 of Potharlanka Village, Kollur Mandal, Guntur District, as illegal and arbitrary'. 4.

Though various grounds are raised, learned counsel for the petitioner submits that the petitioner has made an application on 16.08.2016, before the District Collector-respondent No.2 seeking issuance of patta in respect of the above mentioned land but no order is passed till date. However, he seeks time to make a fresh application before the Tahsildar-respondent No.4, who is the competent authority. Learned Government Pleader has no

objection for the same, provided the fresh application to be filed by the petitioner is in accordance with law.

5.

Having regard to the above, the writ petition is disposed of giving liberty to the petitioner to make a fresh application before the Tahsildar seeking issuance of patta in her favour towards the land in dispute, pursuant to which, the Tahsildar-respondent No.4 is directed to deal with the same within a period of eight weeks from the date of receipt of the said application, in accordance with law.

6.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ JUSTI CE C.PRAVEEN KUMAR 28.12.2016, knl
