HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2908 OF 2017 ORDER:

The case of the petitioner is that he is absolute owner and possessor of the land admeasuring Ac.0.05 cents in Sy.No.295/3 of Gavinivaripalem Revenue Village, Chirala Mandal, Prakasham District. In respect of the said property, the 3rd respondent granted D.K.proceedings in DK/HS/490(V.S)1414, dated 04.05.2005. While so, the 4th respondent granted title and possession certificates in favour of the respondent 5 and 6. In objection to the same, the petitioner made representation on 26.05.2016 before the respondents 2 and 3. In pursuant to the said representation, the 2nd respondent addressed a letter to the 3rd respondent to conduct enquiry. Accordingly, the 3rd respondent conducted preliminary enquiry and addressed a letter to the 2nd respondent on 28.12.2016 stating that they would submit the detailed report later. But as on today, the respondent authorities have not completed the enquiry. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Since it is stated that enquiry is pending before the 3rd respondent, it is for the 3rd respondent to take action in terms of the letter addressed by the 2nd respondent, after issuing notice to the petitioner as well as the respondents.

In view of the same, the 3rd respondent is directed to complete the enquiry stated to be pending in accordance with law within a period of three (03) months from the date of receipt of copy of this order. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending if any, shall stand closed.
