This Writ Petition is filed challenging the action of the second respondent in proposing to issue pattadar pass books and title deeds to respondent Nos.3 to 12 in spite of the objections raised by the petitioner on 13.11.2017 informing about the pendency of suit in O.S.No.84 of 2006 on the file of the learned Principal District Judge, Medak at Sanga Reddy. In view of the nature of relief granted in the present Writ petition, the notice to respondent Nos.3 to 12 is dispensed with and the Writ Petition is being disposed of in view of the innocuous prayer sought for by the petitioner. The petitioner and others claim to be the owners and possessors of land situated in various survey numbers at Pati Ganapuram Village, Patancheru Mandal, Medak District, and they claim to have inherited the said lands from their ancestors.
It is the case of the petitioner that respondent Nos.3 to 12 manipulated the revenue records and in those circumstances, a suit in O.S.No.84 of 2006 was filed on the file of the learned Principal District Judge, Medak at Sanga Reddy, and it is at the stage of completion of trial. However, respondent Nos.
on 13.11.2017 not to issue pattadar pass books and title deeds to respondent Nos.3 to 12.
Mere pendency of a suit will not bar the second respondent from considering the request for issuance of pattadar pass books and title deeds or change of entries in the revenue records, unless there is a Court order. If respondent Nos.3 to 12 submitted an application in accordance with the provisions of the Telangana Rights in Land and Pattadar Pass Books Act and the petitioner has filed objection to the same, the request of respondent Nos.3 to 12 shall be considered along with the objections filed by the petitioner on 13.11.2017 in accordance with the provisions of the said Act and no relief can be granted in the present Writ Petition, except making the position clear, as above.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 14.03.2018 vs
