Puchalapalli Paramdhami Reddy, v. Andhra Pradesh Maintenance And Welfare Of Parents And
THE HON'BLE SRI JUSTI CE A.V. SESHA SAI WRI T PETI TI ON No.9074 OF 2017 ORDER:
Grievance of the petitioners in the present writ petition is nondisposal of the application dated 18.10.2016 filed by the petitioners under the Andhra Pradesh Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (for short, 'the Act') read with Andhra Pradesh Maintenance and Welfare of Parents and Senior Citizens Rule, 2011 (for short, 'the Rules').
The petitioners herein, who are parents of the 2nd respondent herein, filed an application under Section 5 of the said Act and Rule 4(1) of the said Rules. The petitioners herein are senior citizens and they are aged about 86 years.
It is the submission of the learned counsel for the petitioners that though the petitioners submitted their application as long back on 18.10.2016, no action has been taken by the 1st respondent Tribunal. It is further submitted by the learned counsel that under the provisions of Section 5 of the Act, the application is to be disposed of within a period of ninety (90) days. Having heard the learned counsel for the petitioners and the learned Government Pleader, this Court is of the considered opinion that the ends of justice would be served if the 1st respondent is directed to pass appropriate orders on the application dated 18.10.2016 filed by the petitioners herein, on merits, within a period of two (02) months from the date of receipt of a copy of this order.
AVSS,J WP_9074_2017 Accordingly, the Writ Petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. __________________________ JUSTI CE A.V. SESHA SAI Date:15.03.2017 INL
