THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.20424 of 2017 ORDER:

Heard Sri Mangena Sree Rama Rao learned counsel for petitioner and the learned Assistant Government Pleader (Revenue) for respondents.

The petitioner prays for the following relief :- " .... To issue appropriate writ, order or direction one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not mutating the name of the petitioner in the 1-B revenue register for an extent of Ac.2.56 cents in R.S.No.91 of Lakshmipuram Village, Deverapalli Mandal, West Godavari District, in spite of the representation dated 17-09-2016 is illegal, irregular, arbitrary and violative of the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Book Act, 1971 and Rules framed thereunder and also offends Articles 14, 21 and 300-A of Constitution of India consequently direct the 2nd respondent to mutate the name of the petitioner 1-B register ......" .

The Assistant Government Pleader objects to the very maintainability of the writ petition at this juncture by contending that issuing legal notice either for issuing pattadar passbook or maintaining the entries in 1-B Register under the A.P.Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act') is incorrect and illegal, but an application as required by the Act should be made. If such request is made, the inaction continues and then the petitioner can approach this Court complaining delay in disposing of the application of petitioner.

The objection appears to be legal and tenable. Hence, by granting liberty to petitioner to apply as provided under the Act, for all the reliefs, including maintenance of 1-B Register in accordance with the pattadar passbook already issued, the writ petition is disposed of accordingly.
