THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.3313 of 2015 ORDER:
The petitioner is 1st respondent in Election O.P.No.01 of 2013 on the file of Election Tribunal-cum-Junior Civil Judge, Venkatagiri.
2. The 1st respondent herein filed the said Election Petition challenging the election of the petitioner herein and also for order recounting of all votes polled in the election of Sarpanch of Marlagunta Gram Panchayat of Dakkili Mandal held on 31.07.2013. In the said petition, he filed I.A.No.171 of 2014 to issue summons to Mandal Parishad Development Officer, Dakkili Mandal Parishad, Dakkili to produce original documents mentioned in the list enclosed to the said petition. That petition was allowed by order, dated 30.06.2015, on deposit of Rs.1,000/- by the petitioner to defray the expenses of witnesses. The documents mentioned therein are Ballot papers counted, rejected and tendered, marked copies of electoral roll etc. Those documents are maintained by the Election Officer.
3. Challenging the order, dated 30.06.2015, the present revision petition is filed and I am unable to appreciate how the petitioner is aggrieved by the said order when all the documents relating to the election are called for by the Tribunal. No order prejudice to the interest of the petitioner is passed by the Tribunal. In the circumstances the Civil Revision Petition is liable to be dismissed.
4. Accordingly, the Civil Revision Petition is dismissed. Since the main Election O.P. is directed against the election of the petitioner herein, it is needles to observe that the Election Tribunal shall dispose of the said petition, as early as possible, but not later than 30.06.2016. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this revision petition shall stand closed.
