M/S. Sheetal Engineering Works 5-5, Fareednagar Colony, v. Assistant General Manager
HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.10222 OF 2005 ORDER:
No representation for the petitioner.
The Writ Petition is filed seeking Writ of Mandamus to declare the action of the respondents in demanding more than 25% of the One Time Settlement (OTS) amount of Rs.11.00 lakhs and rejecting OTS after crediting 50% of the proposed OTS amount as it amounts to breach of trust and also to declare their (respondents) letter, dated 02.04.2005, including the letter No.F/ADV/SIB/343, dated 11.03.2004, as illegal, arbitrary and without jurisdiction. As seen from the record, no interim order is granted by this Court, at any point of time, in favour of the petitioner, though the matter is pending for the past ten (10) years. It seems, with the passage of time, the matter has rendered infructuous. Learned counsel for the respondents submits that the cause in this writ petition has become infructuous.
Therefore, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
As a sequel thereto, Miscellaneous Petitions, if any, pending in the writ petition stand closed.
