THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10799 of 2019 ORDER::

This writ petition is filed seeking to issue a writ or order, one in the nature of writ of mandamus declaring the action of the respondents in not providing Police protection by acting on the representation dated 13-04-2019 to protect the possession of the petitioner over the land in Sy.No.544 to an extent of Ac.5-02 guntas in Ranagavarigudem village, Dhammapeta mandal, Bhadradri-Kothagudem district, as being illegal and arbitrary and consequently direct the respondents to pass appropriate orders thereon in the interest of justice.

02. Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Home.

03. Learned Asst. Government Pleader for Home submits that unless an injunction order is obtained from competent civil Court, the petitioner is not entitled to Police protection to protect his possession over the subject land from interference from the 3rd parties, especially when 3rd parties also claim rights in the said land.

04. In the circumstances, if the petitioner claim that he is the owner of the land in question by virtue of succession and if he is in possession of the land, the petitioner can avail remedies as are available to him under law. In the circumstances, the writ petition is disposed of reserving liberty to the petitioner to work out his remedies before competent civil Court, if so advised. Consequently, miscellaneous petitions, if any, pending are also disposed of. There shall no order as to costs.
