THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.467 OF 2016 ORDER:

The present criminal revision case is filed by the petitioner challenging the order, dated 30.01.2016 passed in Crl.M.P.No.133 of 2016 in Crl.M.P.No.2303 of 2014 in D.V.C.No.38 of 2014, by the Court of the Judicial Magistrate of First Class, special Mobile Court-XI Metropolitan Magistrate, Cyberabad, L.B.Nagar, whereby the Court below dismissed the petition filed by the petitioner for exempting the personal appearance of the petitioner.

Heard and perused the records.

Learned counsel for the petitioner submits that the Court below erroneously dismissed the petition filed by the petitioner seeking exemption from his personal appearance. He further submits that the Court below issued Non Bailable Warrants (NBWs) to the petitioner and that the matter is posted on 16.02.2016. Hence, he prays this Court to set aside the impugned order.

On perusing the order impugned and hearing both the counsel, this Court is of the view that the Court below insisted the appearance of the petitioner to hear about the payment. Hence, this Court is not inclined to interfere with the order passed by the Court below. However, in view of the submission of the learned counsel for the petitioner that the petitioner will appear on 16.02.2016 before the Court below, the operation of the NBWs issued against the petitioner is suspended till 16.02.2016. With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 10.02.2016 pln
