In this Writ Petition petitioners assail notices dt.02.03.2016 issued to them by the 3rd respondent under A.P. Land Encroachment Act, 1905 proposing to evict them from the subject lands. Petitioners apprehend that before they could submit explanation to the said notices, the 3rd respondent might evict them from the subject lands. 2.
The Government Pleader for Revenue appearing for the respondent states that if the petitioners submit explanation to the impugned notices within a period of four (04) weeks from the date of receipt of a copy of this order, the 3rd respondent will then pass a reasoned order in accordance with law, within a period of six (06) weeks there from, after considering the explanations submitted by them. He assures that the petitioners will not be dispossessed from the subject lands till a final order is passed by the 3rd respondent. 3.
In this view of the matter, the Writ Petition is disposed of directing the petitioners to submit explanation to the notices dt.02.03.2016 issued to them by the 3rd respondent within a period of four (04) weeks from the date of receipt of a copy of this order. If no explanation is furnished to the 3rd respondent within the said time, it is open to the 3rd respondent to decide the matter ex-parte. If explanation is filed by the petitioners to the said notice within the time aforesaid, the 3rd respondent shall pass reasoned orders thereon within a period of six (06) weeks from the date of submission of explanation by the petitioners, after considering the said explanation and communicate his decision thereon to the petitioners. Till final order is
passed by the 3rd respondent, petitioners shall not be dispossessed from the subject lands. There shall be no order as to costs.
4. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
