THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.17539 of 2006 ORDER:

This Writ Petition filed under Article 226 of the Constitution of India challenges the action of respondent Nos.1 to 3 in issuing pattas to weaker sections in Sy.No.245 to an extent of Ac.1.00 cents allegedly without following the procedure contemplated under the Land Acquisition Act, 1894.

This Court, on 23.08.2006, granted interim stay. Thereafter, on 15.09.2010, the said interim order was vacated taking into consideration the averment in the counter affidavit filed on behalf of respondent Nos.1 to 3 that possession of the land in question was taken on 12.08.2006 and the said land was utilized for house sites. It is submitted by the learned counsel for the petitioners that despite addressing a letter, so far no instructions are received from the petitioners.

In view of the above submission, the Writ Petition is closed as being devoid of instructions.

Miscellaneous petitions, if any, shall also stand closed. There shall be no order as to costs.
