THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.42388 of 2016 O R D E R:

Petitioner had filed this Writ Petition challenging the action of the 4th respondent in placing him under suspension pending enquiry by proceedings dt.21.11.2016. 2.

Petitioner contends that no charge memo had been issued to him making any allegations and therefore the order placing him under suspension pending enquiry cannot be sustained.

Sri M.S.R.Chandra Murthy, Standing Counsel appearing for respondents 1 and 2 has placed before me proceedings dt.09.12.2016 of the 4th respondent framing charges against the petitioner.

In this view of the matter, I am of the opinion that the petitioner is not entitled to any relief as regards his suspension pending enquiry.

Therefore, this Writ Petition is disposed of directing the respondents to complete the enquiry into the allegations leveled against the petitioner in the charge memo dt.09.12.2016 within a period of four (04) months from the date of receipt of a copy of this order and communicate their decision thereon to the petitioner. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
