This Criminal Appeal is filed under Section 372 Cr.P.C. by the de facto complainant questioning the acquittal of the respondent Nos.1 to 13 in Sessions Case No.59/S of 2009 of the Special Judge for the trial of cases under S.Cs. & S.Ts. (POA) Act, 1989, Guntur.
2. In view of the judgment of a Division Bench of this Court in D.Sudhakar Vs. Panapu Sreenivasulu @ Evone Water Sree and others[1], since the incident in respect of which the complaint was lodged by the appellant is prior to 31-12-2009, the present Criminal Appeal under proviso to Section 372 Cr.P.C. does not lie.
3. In this view of the matter, this Criminal Appeal is dismissed granting liberty to the appellant to avail any other remedy available to him under law.
4. As a sequel, miscellaneous petitions pending, if any, shall stand disposed of.
