THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.46431 OF 2016 ORDER:

The grievance of the petitioner is that she is the owner of an extent of Acs.1.00 guntas in Survey No.778 and 779 of Bodulabanda, Nelakondapally Mandal of Khammam District having purchased the same by registered sale deed dated 24.03.2011. Her name is entered in the revenue records as the owner and possessor of the land. In the land abutting to her land, a saw mill has been established and is running. There are residential houses constructed opposite to her land. Thus, the area is on the verge of becoming an urban area. While so, the respondents are trying to lay road across the petitioner's land without following due process of law. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner.

Learned Government Pleader for Land Acquisition submits that the 3rd respondent has requisitioned the land but as on today no notification is issued. On instructions he submits that without following due process of law the authorities will not effect the petitioner's land.

Heard Sri S.S.Varma, learned counsel for respondents 3 and 4.

In view of the aforesaid facts and circumstances, the writ petition is disposed of directing the respondents not to dispossess the petitioner without following due process of law. No order as to costs.
