THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.3205 OF 2018 ORDER:
This petition is filed by the petitioner-A8 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.30 of 2018 on the file of the Station House Officer, II Town P.S., Miryalaguda, Nalgonda District, registered for the offences punishable under Sections 120, 120-B, 352, 447 and 506 r/w 34 IPC.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that the petitioner is a Pastor. He is not responsible for the alleged trespass and abuses made. Further, the petitioner has nothing to do with the trust and society properties. No ingredients of the above mentioned sections are made out against the petitioner and ultimately, prayed to allow the petition.
4. On the other hand, learned Assistant Public Prosecutor would submit that investigation can be ordered, without arresting the petitioner-A8.

In view of nature of allegations and submissions made by both sides, the interest of the petitioner is required to be protected.

Under these circumstances, the Station House Officer/Investigating Officer is directed to complete the investigation and file final report, without arresting the
petitioner-A8 in the above crime. The petitioner-A8 shall co-operate with the investigating officer.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
