THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10003 OF 2019 ORDER:

This is a case where petitioners claim that they are the owners of the land in Survey No.111 and Survey No.112 of Relakayapally village, Singareni Mandal, Khammam District, which is under acquisition for the purpose of Seetharama Lift Irrigation Project. The petitioners assert their names are shown in the notification issued for acquisition of the land and they were also issued notice under Section 21 of the Land Acquisition Act (for short, 'the Act') read with 23 of the Act. Thereafter, the petitioners submitted their objections and also their claims before the authority. However, petitioners apprehend that the land acquisition officer, without considering their claims, is about to pay the compensation amount in favour of respondent Nos.5 to 14, under the influence of respondent Nos.1 to 4.

Hence, the present Writ Petition is filed.

Learned Government Pleader placed on record, the award in File No.B/545/2018-4 and File No.B/545/2018-3, dated 26.04.2019. File No.B/545/2018-4, dated 26.04.2019 is general award, wherein the claim of the petitioners as well as respondent Nos.5 to 14 have been taken into consideration and the land acquisition officer, having come to a conclusion that there is a dispute as to whom the compensation has to be paid, ordered for depositing compensation amount with the

authority under Section 77(2) of the Act with respect to the land in Survey Nos.111, 111/2, 112 and 112/2. In those circumstances, the Writ Petition is disposed of leaving it open to the petitioners to approach the authority notified under Section 51 of the Act, as the matter is pending for consideration under Section 64 of the Act by the authority. There shall be no order as to costs.

Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.
