Heard learned counsel for the petitioner and learned Government Pleader for Social Welfare appearing for respondent Nos.1 to 3.
Since this writ petition is a clarificatory writ petition to the earlier order, dated 27.10.2016, passed by this Court in W.P.No.36147 of 2016, notice to respondent No.5 is dispensed with. The undisputed facts of the case are that the petitioner filed a revision before respondent No.1 on 14.10.2016 against the order, dated 27.08.2016, passed by respondent No.2 in CMA No.76 of 2014 in respect of the land admeasuring Ac.1.21 guntas in Survey No.915 of Edurla Bayyaram Village, Pinapaka Mandal, Bhadradri Kothagudem District. When there was a threat of dispossession, the petitioner filed W.P.No.36147 of 2016 and the same was disposed of by this Court vide order, dated 27.10.2016, directing respondent No.
1 to dispose of the revision within six months from the date of receipt of the order, and till disposal of the revision, the respondents were directed not to proceed further in the matter. Now, the learned counsel for the petitioner states that since the order, dated 27.10.2016, does not state with regard to the stay of eviction, the respondents are proceeding with the execution of the order, dated 27.08.2016, passed in CMA No.76 of 2014, when the revision is pending.
Since the revision filed by the petitioner is pending before respondent No.1, the petitioner shall not be evicted from the land in question, till the disposal of the same.
The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:18.04.2017 Note: Issue cc in two days.
