HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2654 OF 2022 O R D E R:
This criminal petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/Accused on bail in connection with Crime No.856 of 2021 on the file of Rachakonda Police Station, Kusaiguda, registered for the offence punishable under Section 376 (2) IPC, 3 r/w.4 POCSO Act, 2012.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The police registered the case on the complaint dt.12.11.2021. The allegation against the petitioner is that the petitioner and two others were engaged by the boy friend of the defacto complainant to kill her father. Accordingly, on 18.07.2021, the boy friend of the defacto complainant namely Bhupal, the petitioner and another person went to the house of the defacto complainant to kill her father. At that juncture, the petitioner allegedly sought to have physical intimacy with the defacto complainant which the defacto
complainant obliged having no other option. There after the petitioner and two others allegedly stabbed the father of the defacto complainant and fled.

Learned Counsel for petitioner submits that the incident took place on 18.07.2021 and after being arrested in the said crime she confessed in Crime No.509 of 2021 and also lodged a written complaint to that effect, basing on which the police arrested the petitioner and produced him before the XIX Addl.Metropolitan Magistrate, Cyberabad at Malkajgiri on 13.11.2021. Further, all the accused in the said crime were already released on bail by the Sessions Court.

Learned Asst.Public Prosecutor submits that charge sheet is already filed in both the cases.

In the said circumstances, the petitioner can be released on bail on his executing personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for likesum to the satisfaction of XIX Additional Metropolitan Magistrate, Cyberabad. The petitioner shall appear before the Trial Court on every date of hearing.
Accordingly, the Criminal Petition is allowed. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
