THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.9990 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, order or direction, more particularly one in the nature of writ of mandamus declaring action of the respondents in not considering and disposing of petitioner's application dt. 31-12-2018 for issuance of pattadar pass books to the Petitioner land situated in S.No.817/184 an Extent of Ac.5.00 of Palvanch village and mandal, Bhadradri Kothgudem District is illegal arbitrary and violation of principles of natural justice and pass such other order or orders as the Hon'ble Court may deem fit, just and proper in the circumstances of the case.'

Perusal of the record reflects that the petitioner submitted an application in Form VI-A under the Telangana Rights in Land and Pattadar Pass Books Act, 1971, seeking mutation in relation to the land admeasuring Acs.5.00 guntas in Survey No.817/184 of Palvancha Village and Mandal, Bhadradri Kothagudem District.

This application in Form VI-A was submitted on 08.09.2017 along with a written representation of the same date. The copy placed before this Court bears out that the office of the Tahsildar, Palvancha Mandal, Bhadradri Kothagudem District, received the same. The petitioner also seems to have submitted a representation to the office of the Collector, Bhadradri Kothagudem District, on 14.12.2017 complaining of inaction. However, no steps have been taken till date.

It is not open to the Tahsildar, Palvancha Mandal, Bhadradri Kothagudem District, to remain unmoved when an application is made in the prescribed format.

The writ petition is accordingly disposed of directing the Tahsildar, Palvancha Mandal, Bhadradri Kothagudem District, to take appropriate action upon the petitioner's application in Form VI-A dated 08.09.2017 and his representation dated 08.09.2017 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
