THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Petition No.30625 of 2016 ORDER: (Per Hon'ble Sri Justice Suresh Kumar Kait) In continuation of order dated 23.01.2017, respondent No.5/father has produced the child today in the Court and handed over to the petitioner/mother. Respondent No.5, who is the natural guardian of the minor child, has every right to meet the child. Therefore, while disposing of the petition, with the consent of both the parties, we hereby allow respondent No.5/father to meet the child-Muqueeth Baig twice in a month i.e, on every first Sunday and last Sunday of the month. We hereby made clear that on Sunday the child will be handed over to respondent No.5 at Reliance Mart, Tolichowki, Hyderabad at 10:00 AM and respondent No.5 shall return the child at 5:00 PM on the same day at the same place.

2) We hereby made clear that if due to unforeseen circumstances the petitioner/mother of the child has any problem to handover the child at the said place, she would make arrangements to comply the directions of this Court. If the child has any problem, may be due to illhealth, the message shall be conveyed to respondent No.5 through SMS on his Mobile Nos.7207636170 and 9290064662 one day in advance.

3) We further made clear that if on a particular day fixed by the Court respondent No.5 is unable to meet the child, said day shall be compensated on the very next Sunday. 4) Since the custody of the child is given to the petitioner/mother keeping in view the welfare of the child, the petitioner shall admit the child in a School in LKG. Therefore, the petitioner/mother shall get admit the child in the SPRINGFIELDS School or any branch thereof or any other school. Failing which, liberty is given to respondent No.5 to move an application for revival of the present petition.

5) We hereby made clear that the child shall be admitted in the school within two weeks from today.

6) The original note book and original progress report of the child were returned to the counsel for the petitioner. 7) In view of the above directions, this writ petition is disposed of. No costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand closed.
