THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION NO.30998 OF 2015 ORDER:

1. Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. In this Writ Petition, the petitioner assails proceedings in Ref.No.E/1306/2015 dated 08.09.2015 of the third respondent placing the fair price shop dealership authorization of the petitioner under suspension pending enquiry.

3. Although the petitioner contended that the sole basis for registering a case under Section 6-A of the Essential Commodities Act, 1955 ("the Act" for brevity) is not mentioned, learned Government Pleader produced show cause notice dated 08.09.2015 issued by the third respondent, which indicates that there has been independent application of mind by the third respondent for suspending the fair price shop dealership authorization of the petitioner and that the suspension pending enquiry was not solely on the basis of registration of case under Section 6-A of the Act against the petitioner.

4. In this view of the matter, I am not inclined to interfere with the order of suspension pending enquiry passed by the third respondent. The third respondent is directed to accept the explanation of the petitioner, if she

submits it within one (1) week from today and then conclude the enquiry into the allegations against the petitioner within four (4) weeks thereafter in accordance with law.

5. The Writ Petition is disposed of with the above direction.

There shall be no order as to costs.

Miscellaneous petitions, if any, pending shall stand closed.
