CVNR, J CC 2321/2015 ORDER:
This contempt case is filed alleging wilful disobedience of order dt.11.12.2014 in W.P. No.36008 of 2014. During the pendency of this contempt case, the respondents have paid certain amounts due to the petitioner as per their calculation. As interest component was not paid, the case was adjourned to facilitate such payment. Today, at the hearing, Mr. Adhi Venkateshwara Rao, learned counsel for the respondents, placed before the Court letter dt.20.11.2017 addressed to the petitioner, wherein it is stated that a cheque bearing No.375598 dt.17.11.2017 for an amount of Rs.3,32,072/- towards interest for the period from 1.4.2009 to 10.06.2017 on the principal amount of Rs.3,38,849/- has been issued.
A copy of the calculation sheet along with a photocopy of the cheque, the original of which has been handed over to the petitioner, has been enclosed to the said letter. Mr. V. Narasimha Goud, learned counsel for the petitioner, while admitting that his client has received the cheque for Rs.3,32,072/- towards purported interest amount, however, submitted that the arrears payable to his client were around Rs.9,00,000/- and not Rs.3,38,849/-.
CVNR, J CC 2321/2015 A perusal of the order passed by this Court in W.P. No.36008 of 2014 shows that the amount due to the petitioner was not quantified. Therefore, if there is any dispute on this aspect, the petitioner shall be free to avail appropriate legal remedy for recovery of the balance money allegedly due to him from the respondents.
As the respondents have paid the purported due amount along with interest as per the direction of this Court, the contempt case is closed subject to the liberty given to the petitioner as above.
