ORDER

Heard learned counsel for the petitioners, learned Government Pleader for Panchayat Raj and Rural Development for respondents 1 and 3, learned Government Pleader for Revenue for respondent No.2 and Sri G. Narender Reddy, learned Standing Counsel for respondent No.4.

The case of the petitioners is that respondent Nos.5 and 6 had encroached upon their lands by making illegal construction of compound wall without obtaining any permission from the Gram Panchayat. The further case of the petitioners is that they made a complaint on 21.04.2019 to the 4th respondent, who in turn has issued a notice on 27.04.2019 to respondent Nos.5 and 6. However, even today, respondent Nos.5 and 6 are continuing to make constructions without there being any permission. Hence, the petitioners filed the present writ petition seeking to declare the action of respondent No.4 in not taking any action against the illegal constructions of compound wall by respondent Nos.5 and 6 in the subject lands.

Learned Standing Counsel, on instructions, would submit that based on the complaint of the petitioners, the respondents have already issued notice to respondent Nos.5 and 6 on 27.04.2019, and further action as required under law shall be taken by the 4th respondent.

As action has already been initiated by the Corporation, no further order is needed in the present case. The petitioners are also at liberty to approach the Civil Court for eviction from the alleged encroachment into their land.

Hence, the Writ Petition is closed. No order as to costs. 6.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
