THE HON'BLE SRI JUSTICE C.V. BHASKAR REDDY Contempt Case No.1915 of 2014 ORDER:

This Contempt Case is filed by the petitioner alleging wilful disobedience of the order passed by a learned Single Judge of this Court in WP.No.4019 of 2011 and W.P.No.32840 of 2010, dated 28.02.2011.

Vide above order, this Court directed respondent Nos.1 and 2 to remove all the encroachments that exist on the road nearby the house of the petitioner, whether such encroachment is made by the petitioner, the 3rd respondent, or even by any other person; and ensure that the road is not encroached by anyone.

Since 2014, the present Contempt Case is pending and a counter affidavit has been filed by the Zonal Commissioner of the respondent-Corporation stating that they have complied the orders of this Court dated 28.02.2011 and removed the encroachments made by the 3rd respondent and other adjoining property owners. 4.

Sri Jithender Rao Veeramalla, learned counsel appearing for the petitioner strenuously argued that the respondents have not complied the orders fully, but they have only removed part of the constructions.

In view of above, this Court is of the considered view that the present Contempt Case can be disposed of by giving liberty to the petitioner to move appropriate application, if any cause survives in the Contempt Case. 6.

Accordingly, the Contempt Case is closed with the aforesaid liberty. No costs As a sequel, miscellaneous applications pending if any in this Contempt Case, shall stand closed. ________________________________ C.V. BHASKAR REDDY, J Date : 02.02.2023 Lk
