ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioner, who is arrayed as accused No.4 in Crime No.573 of 2025 before the Mahabubabad Town Police Station, Mahabubabad District, registered for the offences punishable under Sections 108 read with Section 62 of BNS.

The brief facts of the case are that the de facto complainant, on 30.12.2025 at about 16:00 hours, lodged a complaint before the police stating that the son of the de facto complainant committed suicide due to the abetment of Accused Nos.1 to 4. Accused No.1 is the wife of the victim, and Accused Nos.2 and 3 are the elders of the panchayat. According to the complainant, on 30.12.2025, a panchayat was conducted wherein Accused Nos.1 to 4 blamed the victim, alleging that due to him, Accused No.1 was not having any children and that he was impotent. As such, the victim committed suicide, and subsequently, a dying declaration was recorded by the competent authority. In view of the same, a case was registered under the above sections, and the petitioner was arrayed as Accused No.4.

Heard Sri A. Prabhakar Rao, learned counsel appearing on behalf of the petitioner as well as Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and has been falsely implicated in the present case. He contended that petitioner is the Accused No.4 and there are no specific allegations against the
petitioner and dying declaration of the deceased shows that Accused No.1 only blamed the victim as such he committed suicide. Therefore, he prayed that this Court grant pre-arrest bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the offences alleged are grave and heinous in nature. Therefore, he prayed that this Court may be pleased to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is arrayed as Accused No.4 based on the statement given by the victim to the concerned authority. However, there are no specific allegations against this petitioner, and there is no mention of any panchayat being conducted before the elders.. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Mahabubabad Police Station, Mahabubabad District, within two
weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
