This Writ Petition is filed challenging the action of the respondents 3 and 4 in not entertaining, registering and releasing the documents and deeds submitted by the petitioners and their GPA Holder in respect of the petitioners landed property in Survey No.83/1, admeasuring 180 sq. yards, out of Ac.2-20 gts., situated at Raidurg Panmaktha village, Serilingampally mandal, Ranga Redy District, in spite of declaration by the Urban Land Ceiling Authorities as retainable land in favour of the petitioners and also the proceedings No.B/59/2012, dated 30.04.2012, RC.No.D/59/2012-4, dated 02.06.2012 and proceedings No.G/3719/2013, dated 27.08.2013 of the Tahsildar, Serilingampally Mandal and also the land use information given by the HMDA, vide letter No.103784-LU/P5/HMDA/2014, dated 28.11.2014.
It is needless to observe that when a properly drafted document is presented for registration complying with all formalities, the respondents 3 and 4 have no alternative except to receive the said document and they cannot refuse to receive the document.
In the circumstances, the writ petition is disposed of directing the respondents 3 and 4 to receive the document, if any, presented by the petitioners and take action in accordance with the provisions of the Registration Act. If the respondents 3 and 4 cannot register the said document for any reason, they have to make an endorsement to that effect and pass an order in accordance with Section 71 of the Registration Act.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
