HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.12462 of 2016 ORDER :

This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the docket order, dated 05.08.2016, passed by the learned III-Additional Chief Metropolitan Magistrate, Gajuwaka, in Crl.M.P.No.1123 of 2016 in C.C.No.904 of 2015. The grievance of the petitioner/accused is that while recalling the warrant on Memo, the learned Magistrate has imposed a condition that the accused should furnish personal bond for Rs.25,000/- with two sureties for the like sum each. It is submitted that the petitioner is not able to afford to comply with the said condition imposed by the trial Court. Taking into consideration the facts and circumstances of the case, this criminal petition is disposed of, directing that the order dated 05.08.2016, passed by the learned III-Additional Chief Metropolitan Magistrate, Gajuwaka, in Crl.M.P.No.

1123 of 2016 in C.C.No.904 of 2015, shall stand modified to the effect that the petitioner/accused should furnish personal bond for Rs.10,000/- with two sureties for the like sum each on or before 13.09.2016. Till such time, the warrant issued against the petitioner/accused shall not be executed. The rest of the conditions imposed by the trial Court shall remain same. Pending miscellaneous applications, if any, shall stand closed.
