THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6193 of 2015 ORDER:

This criminal petition is filed by the petitioner - Accused No.4 under Sections 437 & 439 of the Criminal Procedure Code, seeking to grant bail in Crime No.14 of 2015 on the file of Pichatur Police Station, Chittoor District, registered for the offences punishable under Sections 353, 307, 379, 411 and 120-B IPC, and 20(1) (c) (iii) (iv) (ix) and 29 (iv) (A) of A.P. Forest Act, 1967 & Rules 3 & 4 of Sandal Wood & Red Sandal Wood Transit Rules 1969 and Section 55 (2) of Biological Diversity Act, 2002 and Section 27(1) of the Arms Act. Heard and perused the material available on record. The case of the prosecution is that while inspecting the vehicles near Reppalapattu village cross road at about 3.00 p.m., the police of Pichatur PS., found a blue colour car bearing Registration No.

TN 18 8394 coming from KVB Puram in high speed and on suspicion the police asked to stop the said vehicle. Then, the driver of the said vehicle without stopping the same intentionally raised speed of the vehicle and on that the police chased the vehicle and after one kilometer, the driver stopped the said vehicle and got down and started hurling stones on the police. The police apprehended the inmates of the car and on enquiry, they told that they are doing illegal transportation of red sander wood.

Learned Counsel for the petitioner submitted that the petitioner is no way concerned with the offences alleged against him, that the petitioner was in jail from the date of his arrest and the investigation was completed and charge sheet has also been filed. Learned Public Prosecutor opposed this petition on the ground that the petitioner is involved in three similar cases. Hence, this Court is not inclined to grant bail to the petitioner, as there are other cases

also pending against him.
