THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.9963 OF 2019 Date:30.07.2019 Between:

Mohammed Nizamuddin, S/o. Late Mohammed Azeemuddin, aged 47 years, Occ: Private Employee, R/o.H.No.9-5-33, Ibrahimbagh, Hyderabad and others .. Petitioners And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others .. Respondents The Court made the following:

THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.9963 OF 2019 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

2.

Petitioners claim that suit in O.S.No.1284 of 2017 was instituted for partition of the suit schedule properties. However, the same was disposed of by consent award dated 10.02.2018 by Lok Adalat. The petitioners allege that in terms thereof, they are entitled to mutate their names in the revenue records.

Accordingly, they made representation on 12.03.2018 to implement the award dated 10.02.2018 passed by the Lok Adalat. Alleging inaction on the said representation, this Writ Petition is filed.

3.

Though the claim of the petitioners for mutation of their names in the revenue records by award passed by Lok Adalat in O.S.No.1284 of 2017 can be valid, they have to make an application for mutation in the prescribed proforma i.e., in Form VI-A. But, no such application was made by the petitioners and only a representation was made to the District Collector, MedchalMalkajgiri District. Therefore, it cannot be said that the respondents are not acting on the representation of the petitioners. 4.

Granting liberty to the petitioners to make an application in the prescribed proforma for mutation of their names in the revenue records, the Writ Petition is disposed of. If such application is made by the petitioners, the same shall be considered and

appropriate orders are passed within a period of three months from the date of receipt of a copy of this order.

5.

The Writ Petition is accordingly disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. ___________________ P.NAVEEN RAO, J Date:30.07.2019 KH
