THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.40197 OF 2015 O R D E R :
Heard.
Though the prayer is defective, the petitioner in fact is aggrieved by not carrying out mutation in her name.
The petitioner claims to be the successor to her father-in-law as her husband died. The petitioner has asked for mutation as well as for survey and paid the requisite fee. However, under the endorsement, dated 26-09-2015, the 4th respondent has refused to accept the petitioner's application for mutation on the ground that the lands in question stand in the name of her father-in-law and her name cannot be incorporated in the revenue records.
Though the petitioner has filed this writ petition aggrieved by the said endorsement, the petitioner can as well approach the appellate authority and submit her claim for the lands in question. The petitioner is also at liberty to obtain appropriate Succession Certificate from the competent civil court, if so advised.
With the liberty aforesaid, the writ petition is dismissed. No costs Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
