THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.10358 OF 2012 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "to issue writ, order or directions more in the nature of Writ of Mandamus to declare the action of the respondents in interfering with the supply of Purified Drinking Water through R.O. Process as permitted by the Government in rural Area vide G.O.Rt.No.69, dated 28-02-2009 and consequently for a direction to the Respondents to permit the petitioner to supply the Purified Drinking Water to the slum areas in and around of Vijayawada Hill Terrain People."

It is brought to the notice of this Court by Sri Gangadhar Chamarthy, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj for respondent Nos.1 and 2 and Sri R. Sudheer, learned counsel for respondent Nos.3 to 5 that the issue in the present writ petition is squarely covered by the order of this Court, dated 09-04-2012 passed in W.P.No.25544 of 2011 and a copy of the same is also placed on record.

The operative portion of the said order reads as under: "In the facts and circumstances of the case, I am inclined to dispose of the writ petition. If the petitioner is

conducting the activity of supplying purified water to the people living in slum areas or to people who are in need of water, and such activity needs licence under the provisions of the Act, it is left open for the respondents Corporation to take action against the petitioner by giving appropriate prior notice, in accordance with law. Resultantly, without following due process of law, the officials of the respondent Corporation shall not interfere with the activity of the petitioner in supplying the purified drinking water through reverse osmosis process to the people living in slum areas in and around of Vijayawada Hill Terrain."

Following the above said order and for the reasons recorded therein, this writ petition also stands disposed of, in terms thereof. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
