THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.4459 OF 2017 ORDER:

This Civil Revision Petition is filed under Section 115 of C.P.C. challenging the orders dated 31.07.2017 in E.P.No.08 of 2017 in O.S.No.166 of 2004 on the file of the Court of the Senior Civil Judge, Rayachoty.

Learned counsel for the petitioner submitted that the petitioner is ready and willing to clear off the E.P. amount within six months.

Learned counsel for the first respondent submitted that six months time may be granted to the petitioner to pay the decretal amount.

In view of the submissions made by the learned counsel for both parties, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both parties, the petitioner is directed to clear off the E.P. amount on or before 30.06.2018. If the petitioner fails to clear off the E.P. amount within the time stipulated above, the first respondent is at liberty to obtain an arrest warrant against him in pursuance of the orders dated 31.07.2017 in E.P.No.08 of 2017 in O.S.No.166 of 2004 on the file of the Court of the Senior Civil Judge, Rayachoty. The first respondent is permitted to withdraw the deposited amount and

also the amount that will be deposited by the petitioner in future also.

With the above directions, the Civil Revision Petition is disposed of. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
